Contemplating legal action against a client for non-payment will only ever be seen as a last resort and should not be undertaken lightly. Those of you who have ever had to do this will agree that it is a stressful business. Sometimes it can be hard to access the information you need without going to the additional expense of hiring a lawyer.

I have prepared an Advice Note which gives some information on the processes for taking legal action. The information was correct at the time of preparation, but remember that things do change - so please recheck that the details are correct before embarking on this course of action. The Advice Note also points out some of the differences in the English and Scottish legal systems and provides links to other sources of useful information.

Thanks Emma. Always worth having a range of options.

I actually took my client to court for non-payment and got everything plus costs and interest. However, it was stressful, time-consuming and an unwelcome sidetrack when I was trying to concentrate on building my business. This is why I now insist on a signed contract and deposit before I start work for a new client because it is simply not worth the hassle.
