Well,
The Regs have been completed and guess what? That's right I have to register under both TCSP and ASP. What a shock!
Under the TCSP rules it states:
6.1.1 What is a Trust or Company Service Provider (TCSP)?
A Trust or Company Service Provider is any firm or sole practitioner who by way of business provides any of the following services to third parties:
(a) forming companies or other legal persons
(b) acting or arranging for another person to act;
(i) as a director or secretary of a company
(ii) as a partner of a partnership; or
(iii) in a similar position in relation to other legal persons
(c) Providing a registered office, business address, correspondence or administrative address or other related services for a company, partnership or any other legal person or arrangement;
Obviously I am registering as I provide mailing address services but what would administrative address mean? I have a client who puts 'The Accounts Department' followed by my office address on all his invoices so that everything comes directly to me. He is not registered on my mailing address list as I thought I was just being a VA. Thought I had better let you know in case any of you do similar things. I think if you do you may come under the TCSP rules.
I also get to register under the ASP section as well as it now states:
7.1.5 What types of businesses will be covered?
Businesses covered include;
• Accountants
• Auditors
• Tax Advisers
• Book-keepers
• Payroll Agents• Tax consultants
• Customs Practitioners
• Interim managers undertaking any of the activities of the businesses listed above
So that's pretty clear then!! There are exeptions and of course if you are a fully qualified ICB member then you won't need to register.
Luckily the £95 for the ASP also covers the £95 for the TCSP and I only have to pay an additional £50 for the 'Fit and Proper' test.
In case you haven't already been informed:
7.2.1 Registration as an Accountancy Service Provider
If you carry on business as an ASP you must be registered with HMRC before the 1st January 2009. In order for us to be able to process your application on time you will need to complete and send your application form with the appropriate registration fees to us by the 30th September 2008.
If you are setting up in business as a new ASP you must be registered with HMRC before the 1st January 2009.

Thanks for that timely reminder Sarah. I now have until the end of September to part with dosh and send form!
Have you done the rest of it and set up policies and procedures to show that you are taking this seriously? I've just downloaded and printed all 73 pages of Notice MLR8 which allegedly gives details of how to do this, but one glance made me feel ill, so I've carried on with the transcription work today! I dare say I shall have to gird my loins and do battle with HMRC language and turn it into something that I can show them if ever they need to see that I do follow procedures.... at some stage.... too busy earning money at the mo! _________________ Carole Meyrick
